Subject: -   Stop repression of worker’s movement in SIDCUL Pantnagar  , Uttarkhand.

Sir,

 The incidents of repression of worker’s movement are increasing day by day in the state of uttarkhand. The labor laws are not being implemented and police force is being used usually to deal with worker’s movement. In a recent incident of SIDCUL Pant Nagar Industrial belt, when a worker in a vendor company of TATA namely  Automotive stumping and assembling limited  (ASAAL) was killed due to negligence of management on 30.05.2013 , other co-workers of the company started agitation. It is pertinent to mention here that workers in this company are agitating for their demand, since a long time. There is an illegal practice of not employing permanent workers and keep them for a long period as trainee. In most of the cases it goes upto three years. This practice of employing workers was declared illegal by the deputy labor commissioner Rudrapur. However, on 28.05.2013 remaining long serving 170 trainees were fired by the management of ASAAL and unit was started with new trainees and due to this negligent act of the management, the above mentioned accident killing a worker happen.

The workers of the company started agitation demanding appropriate compensation to the   dependant of the killed worker and implementation of labor laws in the company. They were demanding regularization of long serving workers, who are still working there as trainee even after three years of their employment. Uttarakhand government and its labor department are in hand-in glove with the factory management and they did not address the demand of the workers and resorted to police repression , by arresting 98 workers  under apprehension to breach of peace implying section151 on 06 and 07 June 2013. They have been arrested under section151, however they have not been released till today, and this shows the total apathy of administration towards worker’s rights.

We undersigned demand that:-

All arrested workers are released immediately.

Illegal practice of hiring trainee is stopped immediately and workers be regularized immediately.

Stop police atrocity on worker’s movement.

Krantikari Lok Ashikar Sangathan has launched a campaign against state policies of repression of democratic movements. Rights of workers' peasants' , Dalit, Adivashis , women and other oppressed sections of the society is being curtailed.  During the compaign launched by KRALOS a protest meeting -cum  day long Dharna was staged at Jantar-Mantar in Delhi. A memoradum of demands was also presented to the Prime Minister of India. (copy attached  ) The Dharna was addressed by Shri P.P. Arya president Krantikari Lok Ashikar Sangathan, Shri Arjun Prasad of PDFI, Rajni from Pragatisheel Mahila Ekta Kendra, Nitin Mundepi of Parivartankami Chhatra Sangathan, Sunil Kumar Krantikari yuva sangathan and J.P.Narela. The meeting was conducted by Bhupal Singh .

Subject: -   To restore Constitutional rights, enlarge democratic space and stop repression of democratic movements in India

Sir,

We are concerned with the increasing attack on people’s right guaranteed under the constitution of India. You have responsibility to uphold the constitutional mandate under which each and every citizen of India has got right to life and liberty. As an Indian citizen we feel that very basic ‘right to life’ of Indians is under threat from the state machinery. Instead of protecting the right of the citizen in a democratic country like India, the Indian state machinery is instrumental in unleashing onslaught on common masses including workers, peasantry, student& youth, Dalits, tribals, women and other oppressed sections of the society. Even doctors, teachers and lawyers often taste the lethal attack of oppressive state machineries.     

On 15^th August 1947 our country got independence from the oppressive colonial rule and  in 1950 it became republic based on principles of justice  and equality, however the power shifted in the hands of ruling capitalist class. The hope of Indian citizens got belied within a short span of time when ruling capitalist class and its allies opted same tactics to suppress the Indian masses which was used by their predecessor British Rule. Jaliawalan Bagh type Massacre got repeated at many places. You may not forget Arwal massacre ,  Sopore massacre, Gulbarg Society massacre,  massacre in Gujrat after Godhra incident  still reminds Jaliawala bagh massacre where general Dyre had ordered massacre of innocent protesters in Amritsar on 13 April 1919.

People’s movements are facing unprecedented repression not witnessed in recent past. The state machinery is violating its own norms and written constitution. ‘Rule of law’  has no meaning when people’s movement armed with constitutional rights pose a challenge to anti-people state policies. Whether, it is movement against price-rise, demand for basic facilities i.e. water, power, education, employment or against corporate –plunder of natural resources, restoration of trade union rights etc., the sate response is same.  

Recently, when women & students organizations were protesting against Delhi Gang Rape case at India Gate, a curfew like situation was created. Section 144 of Cr.P.C. was invoked in entire New Delhi district in order to clamp the entire area.

55000 activists who were opposing nuclear project in Kudankulam in Tamilnadu were booled under Sedition law, those who are opposing plunder of natural resources are being subjected to ‘Oppression Green Hunt’.

Industrial workers have been ruined the protection they were having under pre-liberalization era of so-called welfare state.

People in North –eastern part of the country and Kashmir are being treated differently by the Indian state. It has become killing field for military and para-military forces.  Armed Forces Special Power act has robbed them of their basic human rights, however demand to scrap this draconian law has gone in vain.

Our democratic country does not rely upon capabilities of its citizen for gaining strength and making it a strong developed nation but it believes in  colleting lethal machinery  to oppress its masses. Indian army and local police was not sufficient for this capitalist state thus it established PAC, SGO, STF, and different types of commandos.

Draconian laws  come one after another . When TADA was protested, POTA came into existence , now UAPA is doing the same job.

We expect that you being head of the executive and leader of Indian parliament turn the tide to protect the democratic rights of our citizen thus on the 94^th Anniversary of Jalianwala Bagh  Massacre we have come to put forward demand of peaceful citizen of India before you.

1.      Law of sedition which has British  lineage should be scrapped immediately.

2.      Armed Forces special power Act in North eastern State and Jammu & Kashmir should be scrapped immediately.

3.      Oppression of Maruti Suzuki workers in Gurgaon- Manesar plant should be stopped immediately and false and fabricated cases against workers should be withdrawn.

4.      ‘Oppression Green Hunt’ going on in central India should be stopped immediately.

5.      Withdraw the cases under Sedition law clamped upon activists of people’s movement.

6.      Forces involved in torture, lodging false F.I.R. custodial death and custodial rape, abduction etc. should be punished.

7.      The scope of ‘Right to Information’ should be enlarged and confidentiality clause should be removed.

8.      Scrap the constitutional provisions and other law which limit the rights of Indian Citizen.

We hope  that you shall   act upon our representation to   protect the right of each and every citizen of India.
